These Terms and Conditions (“Terms”) govern your use of the “Golazo” mobile application (the “App”), operated by Khueon Studios (“we”, “us”, “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country). If you are a minor, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial entertainment, subject to these Terms. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the App except as permitted by law.
3. AI-Generated Content
The App uses artificial intelligence to generate images from photos you provide. You understand and agree that:
- Generated images may be inaccurate, unexpected, stylized, or may not realistically resemble any real person.
- Generated content is provided for personal entertainment purposes only.
- You are solely responsible for how you use, publish, or share generated images.
4. Your Content and Responsibilities
You are responsible for the photos you provide. By using the App, you represent and warrant that:
- You own or have the necessary permissions to use any photo you upload;
- You have the consent of any person appearing in a photo you upload;
- You will not upload content that is illegal, infringing, defamatory, sexually explicit, hateful, harassing, or that violates the rights of others.
You retain ownership of the photos you provide. You are responsible for ensuring your use of any generated image complies with applicable laws, including intellectual property, likeness, and publicity rights.
5. No Affiliation; Likeness and Trademarks
The App is not affiliated with, endorsed by, sponsored by, or associated with any footballer, athlete, or their related individuals, teams, clubs, leagues, sponsors, or organizations. All player names, trademarks, and likenesses referenced are the property of their respective owners. The App is intended for personal entertainment only. You are responsible for ensuring that any generated image does not infringe the rights of any third party, including publicity, likeness, and trademark rights. We make no representation that commercial use of generated images is permitted.
6. Virtual Currency (Coins)
The App uses virtual currency (“coins”). You acknowledge that:
- Coins are a limited license to a digital feature and have no monetary value. They cannot be redeemed for cash, and cannot be transferred or sold.
- Coins may be obtained through purchases, rewarded ads, or promotional bonuses.
- We may change coin pricing, bonus amounts, or availability at any time.
- Coins are tied to your device and may be lost if you uninstall the App, clear App data, or change devices, as the App has no account system or cloud backup.
- Except where required by law, coins and purchases are non-refundable once delivered.
7. Purchases and Refunds
In-app purchases are processed by Google Play and managed via RevenueCat. All purchases are subject to the Google Play terms of service. Refund requests are subject to Google Play's refund policies; we do not directly process payments or issue refunds outside of Google Play.
8. Rewarded Advertising
The App offers rewarded advertisements (served by Google AdMob) that grant coins in exchange for viewing them. Ad availability is not guaranteed, and we are not responsible for the content of third-party advertisements.
9. Prohibited Conduct
You agree not to:
- Use the App for any unlawful or abusive purpose;
- Upload photos of others without their consent;
- Attempt to generate content that is sexually explicit, involving minors, harassing, hateful, or that misrepresents or defames any person;
- Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems;
- Use automated means to manipulate coins, ads, or purchases.
10. Content Reporting and Moderation
You may report AI-generated content you find objectionable using the in-app reporting feature. We use these reports to improve content filtering. We reserve the right, but are not obligated, to monitor or remove content, or to restrict users who violate these Terms.
11. Intellectual Property
The App, including its design, code, graphics, and branding (excluding third-party content and your uploaded photos), is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
12. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that generated content will meet your expectations.
13. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid through the App in the twelve (12) months preceding the claim or USD 50, whichever is greater.
14. Indemnification
You agree to indemnify and hold harmless Khueon Studios from any claims, damages, liabilities, and expenses arising from your use of the App, your use of generated images, or your violation of these Terms or the rights of any third party.
15. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or for any other reason. Upon termination, the license granted to you ends immediately.
16. Governing Law
These Terms are governed by the laws of Pakistan, without regard to its conflict of laws principles. Any disputes shall be subject to the courts located in that jurisdiction.
17. Changes to These Terms
We may modify these Terms at any time. Updated Terms become effective when posted, as indicated by the “Last updated” date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
